Act for Violation of the Guidelines
NBDC Guidelines for Human Data Sharing clearly disclose "In case the data user used human data in violation of the NBDC Human Data Sharing Guidelines etc., or caused information leakage etc. in using data intentionally or with negligence, the DBCLS may take one or more further actions such as rescinding of permission for data use, reporting of the fact to the head of the organization to which the data user belongs, announcing of the fact on the website etc., and so on." in the section 5.3.3.
[Action to non-submission of reports during and at the end of the data use]
The guidelines also stipulate that
- 10. When finished with using data, the data user must delete all data obtained from the NBDC Human Database (..) and all the data that can restore the data in accordance with the NBDC Security Guidelines for Human Data (..), and report on the use (and deletion) of the data, using "Reporting on the completion of data use" in the section 5.3.3.
- 6. In principle, the data user reports on data use status every year, using "Reporting on the Use of Controlled-access Data" in the section 5.4.3
If any report is not submitted, the following actions shall be taken by the Human Data Review Board Office.
- The system will send e-mail alerts every 30 days to 180 days up to 6 times after the end of data use. (The email after 180 days will be sent also to the head of the organization.)
- Data use shall be restricted not to download data and add set data, etc, in 180 days after the end of data use.
- The fact shall be shared with data submitter about the data user who has been restricted.
- If data user does not respond after 180 days, the secretariat of the Human Data Review Board shall send a reminder email directly.
- In case of no response after all, the secretariat of the Human Data Review Board shall send an email to the head of the organization or the research collaborators.
In the future, we may release personal data to the minimum extent.
